200 East Van Buren — Booking Portal Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the booking portal located at 200evbphx.com (the “Portal”), operated by Pivot 200 EVB LLC (“we,” “us,” or “our”) on behalf of 200 East Van Buren, Phoenix, Arizona 85004.

By accessing or using the Portal, creating a booking, or submitting an inquiry, you agree to be bound by these Terms. If you do not agree, do not use the Portal.

1. Services

The Portal allows you to browse, inquire about, and book the following space types at 200 East Van Buren:

  • Hot Desks — shared open workspace available by the day or monthly membership
  • Dedicated Desks — assigned workspace available on monthly membership terms
  • Cubicles — semi-private workspace available on monthly membership terms
  • Meeting Rooms — bookable conference, training, and podcast studio spaces available by the hour or day
  • Event Space — The Grand, available for full-day and multi-day events
  • Private Suites — private offices ranging from small single offices to full floor plates, available on lease terms of 1–5 years

Availability, pricing, and specific terms for each space type are displayed on the Portal and are subject to change without notice.

2. Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding agreements on behalf of yourself or your organization to use this Portal. By completing a booking, you represent that you meet these requirements.

3. Bookings and Reservations

3.1 Holds. When you initiate a booking, a temporary hold is placed on the selected space. Holds expire if payment is not completed within the allotted checkout window. Completing payment converts the hold into a confirmed reservation.
3.2 Confirmation. A booking is confirmed only after successful payment processing and issuance of a written confirmation. Confirmation emails are sent to the address provided at time of booking.
3.3 Suite Inquiries. Inquiries for private suites do not constitute a reservation or binding commitment. A lease will be prepared separately and must be executed in writing before any space is reserved.
3.4 Accuracy of Information. You agree to provide accurate contact and billing information. Bookings made with false or inaccurate information may be cancelled without refund.

4. Payment

4.1 Processing. All payments are processed securely through Stripe. We do not store your full card details on our servers.
4.2 Pricing. All prices displayed are in US Dollars. Applicable taxes are calculated at checkout based on current Arizona transaction privilege tax rates and are added to the displayed price.
4.3 Damage Deposit — Event Space. Bookings for The Grand event space require a refundable damage deposit of $2,500, authorized on your card at the time of booking as a separate transaction. The deposit is not charged; it is held and released within 5 business days following the event, provided no damage or policy violations occurred.
4.4 Failed Payments. If a payment fails after a hold has been placed, the hold will be released and the space will become available to other guests.

5. Cancellations and Refunds

5.1 Meeting Rooms and Hot Desks.
  • Cancellations made 48 hours or more before the booking start time: full refund.
  • Cancellations made less than 48 hours before the booking start time: no refund.
5.2 Event Space (The Grand).
  • Cancellations made 30 or more days before the event date: full refund minus a $250 processing fee.
  • Cancellations made 14–29 days before the event date: 50% refund.
  • Cancellations made less than 14 days before the event date: no refund.
5.3 Monthly Memberships (Dedicated Desks and Cubicles). Month-to-month memberships may be cancelled with 30 days written notice. 12-month commitments are non-refundable after the first 5 business days following execution.
5.4 Force Majeure. In the event of building closure, natural disaster, government order, or other circumstances outside our control that prevent access to the space, we will issue a credit or reschedule at no additional charge. Refunds in such cases are at our discretion.
5.5 Process. To request a cancellation or refund, contact us at leasing@200evbphx.com with your booking reference number.

6. Rules of Use

By completing a booking, you agree to the following:

6.1 You will not use the space for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation.
6.2 You will not engage in behavior that disrupts other tenants, guests, or staff, including excessive noise, harassment, or threatening conduct.
6.3 You will not bring hazardous materials, illegal substances, or unauthorized animals onto the property. Service animals are permitted in accordance with applicable law.
6.4 You are responsible for any damage to the space, furnishings, or equipment caused by you, your guests, or your vendors during your booking period. Damage costs will be charged to the payment method on file.
6.5 You will comply with all posted building policies, including those relating to parking, security, fire safety, and after-hours access.
6.6 Catering, food service, and alcohol must comply with applicable Arizona laws. Alcohol service at private events requires appropriate licensing. We reserve the right to require proof of licensure.
6.7 The maximum occupancy posted for each space must not be exceeded at any time.

7. Intellectual Property

All content on the Portal, including text, photographs, graphics, and the Portal’s design, is owned by or licensed to Pivot 200 EVB LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from Portal content without our prior written consent.

8. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

The Portal and all services are provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Portal will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy of space availability or pricing information displayed on the Portal at any given time.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Pivot 200 EVB LLC and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Portal or the spaces, including but not limited to loss of business, loss of data, personal injury, or property damage not caused by our gross negligence or willful misconduct. Our total liability to you for any claim arising from a booking shall not exceed the amount you paid for that specific booking.

11. Indemnification

You agree to indemnify and hold harmless Pivot 200 EVB LLC, its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Portal, your breach of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Portal shall be resolved in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction in those courts.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of the Portal after changes are posted constitutes your acceptance of the revised Terms.
